How to verify a Certificate of Occupancy

Short answer

A C of O is the state's grant of a right of occupancy for a term, usually 99 years. Verify it by instructing a lawyer to conduct a search at the state land registry using the file number and property description, and by confirming the survey coordinates at the survey office. A document in hand proves nothing until the registry confirms it.

What it is

Land in Nigeria is held under a statutory right of occupancy granted by the state. A C of O evidences that grant for a term, subject to conditions such as permitted use and payment of ground rent.

How to verify

  • Take the file number, plot description and holder's name from the document.
  • Instruct a lawyer to conduct a formal search at the state land registry.
  • Confirm the survey coordinates at the state survey office.
  • Check ground rent status and whether any conditions have been breached.

Common problems

  • A genuine C of O covering a larger parcel, while the plot being sold is a subdivision without consent.
  • A document in a name that does not match the seller, with no chain of transfer.
  • Forged seals and signatures that only a registry search exposes.
  • Land under acquisition where a C of O was never validly granted.
